The client agrees to these Terms automatically.
Definitions
For the purpose of these conditions ‘the client’ is any individual who has made a payment to Photography by Jemma (Jemma Roddis) for a photography session, along with all attendees of the photography session the payment relates to.
Agreement
This contract comes into effect from the date of receipt of any payment by the client to the Photographer. By making a payment to the photographer the client agrees to these Terms and Conditions. Unless otherwise agreed in writing, all services and goods provided to the client will be subject to the terms and conditions of this agreement.
The photographer has the right to change information regarding rates and agreements at all times.
Deposits and Payment
A deposit of £50 is non refundable and deducted from the final balance of the package.
Upon payment of the deposit, the Photographer will reserve the client session date. The Photographer will not hold the session date and will have no liability for, or duty to, photograph the session until the deposit is paid.
The remaining balance is due 7 days before the session.
If the client wishes to upgrade to a more expensive package the difference is paid after the session once the client have received their gallery.
Due to the bespoke nature of photography, digital images are non refundable upon delivery of your online gallery.
All payments are made via bank transfer.
Cancellation
The client reserves the right to cancel a photoshoot up until 14 days before the date of the photoshoot for a refund. This does not include the £50 deposit.
To cancel a contract, the client must send written notice via email to the photographer.
Failure to perform
If the Photographer is unable to attend the clients photo session or provide the services that has been commissioned for, due to unforseen circumstances including but not limited to illness, injury, emergency, fire, casualty, strike, act of god or cause beyond the control of the Photographer, the Photographer shall organise for a photo session to be rebooked at a convenient time for both parties.
Rescheduling
If for any reason the client wishes to reschedule the session, the deposit will be applied to the new date agreed by both parties.
Artistic Rights
The Photographer retains the right of discretion in selecting the photographic materials released to the client.
The photographer has the right to refuse any requested edits to the images and will not release unedited digital files or RAW files.
Client Usage
The Client's prints and digitals are for personal use only and shall not be submitted to contests, sold, reproduced, supplied to media or commercial businesses. The photographer shall not be held accountable for any dispute, claim, damage or legal costs arising out of the clients use of the images.
Photographers Usage
When booking a photo shoot, the client gives permission to the photographer to use the images taken for business and commercial purposes, ie Website and Social Media. If the client does not wish this, the client must inform the Photographer.
Copyright
The entire copyright, title, and intellectual property rights of any Images will remain that of The Photographer at all times.
Client Confidentiality
The Photographer will not disclose to third parties or make use of information communicated by the client in confidence for the purposes of the photography session.
Complaints
All complaints should be made in writing via email to the photographer.
Liability
The photographer is not liable for physical or material damage caused during the photo shoot, unless there is gross negligence or intent on the part of the photographer.

- Direct interactions. You may voluntarily give us your Identity Data, Contact Data, Marketing and Communications Data by filling in forms or by corresponding with us via our website or by post, phone, email or otherwise.
- Automated technologies or interactions. As you interact with our website, we may automatically collect Usage Data about your equipment, browsing actions and patterns. We collect this personal data by using cookies, server logs and other similar technologies.
- Usage Data from analytics providers such as Google.
How is this information used?
- We will only retain your personal and non personal data for as long as necessary to fulfil the purposes we collected it for.
- The information you have voluntarily provided may be used to manage our relationship with you and provide you with information about our services and updates to your orders and commissions.
- May use your feedback to improve services and products offered to the public.
- To deliver relevant website content and advertisements to you and measure or understand the effectiveness of the advertising served to you.
Information will never be sold, exchanged, transferred to any commercial/ non commercial company without the users consent, other than for the purpose of carrying out and delivering the commissioned service requested.
